Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Padel Platform mobile application, companion watchOS application, and website at padelplatform.app (collectively, the "Service"), operated by Consultia ApS ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Account Registration

To use the Service, you must create an account using one of the available sign-in methods (email/password, Google, Apple, or phone number). You agree to:

• Provide accurate and complete information during registration.
• Keep your login credentials secure and confidential.
• Notify us immediately of any unauthorized use of your account.
• Be responsible for all activity that occurs under your account.

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent.

3. Match Recording & Video Content

The Service supports automated video recording of padel and tennis matches at participating venues equipped with cameras. By using the Service at such venues, you acknowledge and agree that:

• Matches you participate in may be recorded by venue cameras.
• Recordings may capture you and other participants on or near the court.
• Match recordings and generated highlight videos are stored on our servers and made accessible through the Service.
• Match recordings, highlights, and live streams may be displayed alongside advertising or sponsored content (see Section 6).
• You may mark matches as "private" to restrict visibility, or leave them as public where other users of the platform may view them.
• Venue operators are responsible for informing players about the presence of recording equipment at their facilities.

You must not use recorded content for any unlawful purpose, and you must respect the privacy and rights of other individuals who appear in recordings.

4. Health & Fitness Data

If you use the companion Apple Watch application, the Service may collect health and fitness data through Apple HealthKit, including:

• Heart rate (average and maximum during matches).
• Active energy burned during matches.
• Workout sessions (written to HealthKit as tennis workouts).

This data is collected only when you actively use the Apple Watch app during a match and grant HealthKit permissions. Health and fitness data is displayed in your match statistics and stored with your match records. In accordance with Apple's guidelines:

• Health data is never shared with third parties.
• Health data is never used for advertising or marketing purposes.
• Health data is never sold to data brokers or any other entities.

5. User-Generated Content

You may create and submit content through the Service, including:

• Player contact names and profiles.
• Match scores, statistics, and game data.
• Match privacy settings.

You retain ownership of your content, but you grant us a non-exclusive, worldwide, royalty-free license to:

• Store, display, and process your content as necessary to provide the Service.
• Display your content (including match recordings, highlights, and live streams) alongside advertising or sponsored content.
• Use your content (including match data, statistics, video recordings, and gameplay patterns) to develop, train, and improve artificial intelligence and machine learning models for features such as automated scoring, highlight generation, and statistical analysis (see Section 7).

When your content is used for AI model training, it may be aggregated with data from other users and anonymized where feasible. Health and fitness data collected through Apple HealthKit is explicitly excluded from AI training and advertising use.

This license terminates when you delete your account, except where: (a) retention is required by law, or (b) your content has already been incorporated into aggregated, anonymized datasets or trained AI models in a manner that cannot reasonably be reversed.

6. Live Streaming & Advertising

The Service may offer live streaming of matches and display advertising or sponsored content. By using the Service, you acknowledge and agree that:

• Live streams, match recordings, and highlight videos may be displayed alongside advertisements, sponsor logos, overlays, or other commercial content.
• Advertising may be served by us or by third-party advertising partners. Third-party ad services may collect certain data (such as device identifiers and interaction data) in accordance with their own privacy policies.
• We do not share your personal account information (name, email, phone number) with advertisers. Any data used for ad targeting is handled in accordance with our Privacy Policy.
• Matches marked as "private" will not be included in public live streams or used for advertising purposes.

We reserve the right to determine the type, placement, and frequency of advertising displayed within the Service.

7. AI & Data Analysis

We may use artificial intelligence and machine learning technologies to analyze match data and improve the Service. This includes, but is not limited to:

• Automated scoring: Analyzing video and match data to automatically detect and record scores during matches.
• Highlight generation: Identifying key moments in match recordings to automatically create highlight videos.
• Statistical analysis: Processing match data to generate advanced statistics, performance insights, and trends.
• Service improvement: Training and refining AI models to improve accuracy and introduce new features.

Data used for AI and machine learning purposes may include match scores, statistics, gameplay patterns, timestamps, and video recordings. Where feasible, data is aggregated and anonymized before being used for model training. The following data is never used for AI training:

• Health and fitness data collected through Apple HealthKit.
• Account credentials (passwords, authentication tokens).

AI-generated outputs (such as automated scores or highlights) are provided as-is and may not always be accurate. You should verify any AI-generated content before relying on it.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to gain unauthorized access to any part of the Service.
• Use the Service to harass, abuse, or harm other users.
• Distribute match recordings or personal data of other users without their consent.
• Reverse engineer, decompile, or disassemble any part of the Service.

9. Third-Party Services

The Service relies on the following third-party services to operate:

• Firebase (Google): Authentication and user account management.
• Microsoft Azure: Video storage and processing.
• Cloudflare: Video streaming and delivery.

These services are governed by their own terms and privacy policies. We are not responsible for the practices of these third-party services.

10. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Consultia ApS and protected by applicable intellectual property laws. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Service as intended.

11. Account Termination

You may request deletion of your account at any time through the app's Profile screen. Upon requesting deletion:

• Your account will be scheduled for permanent deletion.
• A platform administrator will remove your account and associated data within 30 days.
• You may cancel the deletion request by signing in again within the 30-day period.

We reserve the right to suspend or terminate your account if you violate these Terms or engage in behavior that is harmful to other users or the Service.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Consultia ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim, if any.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Denmark.
